The maximum is the ordinary end of the sentence as DOC calculates it, unless another lawful basis for custody exists.

Scheduled vs. actual: A court term, minimum date, review month, RRRI minimum, or favorable parole decision can precede the day a person physically leaves custody.

A detainee awaiting trial is different. There may be no sentence to calculate. Bail can be posted, changed, or revoked; charges can be dismissed; and another court order can alter custody. Even after an order, processing and other holds may remain. For a person in Montour County Prison, the county custody record is the best source for the actual departure. Montour Release Minimums, Not 85%

Pennsylvania expressly rejects a universal rule that a person must serve 85 percent of the maximum sentence before parole. Under 42 Pa.C.S. § 9756, a court generally sets a maximum and a minimum no greater than half the maximum. Under 61 Pa.C.S. § 6137, the Board generally cannot grant ordinary parole before the judicial minimum expires. Reaching that point makes a person eligible for consideration, not entitled to release.

There is also no single Pennsylvania “good-time percentage” that automatically cuts every state sentence. Qualifying presentence custody credit under 42 Pa.C.S. § 9760 credits time already spent in custody under the statute. It is not a reward for good conduct. Montour RRRI Release Calculations

The Recidivism Risk Reduction Incentive Act creates a separate incentive minimum for qualifying state prisoners. Under 61 Pa.C.S. Chapter 45, the court imposes an RRRI minimum when the person meets the statutory criteria and directs DOC to calculate it. If the ordinary minimum is three years or less, the RRRI minimum is three-fourths of that minimum. If the ordinary minimum exceeds three years, it is five-sixths. An RRRI minimum still does not guarantee release. DOC assessment, an individual plan, program completion, conduct, a sound reentry plan, notice to the court and prosecutor, continued eligibility, certification, and the parole decision all play a role. Short Sentence Parole under 61 Pa.C.S. § 6137.1 is another narrow state route with its own criteria. Neither program is a Montour County jail formula.

County custody needs its own analysis. No Montour-specific public good-time or weekend-release policy was found. Montour Home Plans Delay Release
